Terms of Use

1. The service

Simon Sketch is an app for learning to draw: step-by-step portraits drawn by AI, tracing with the camera and the Mash-up game. We may change and improve features.

2. Age and account

The app is for users aged 13 and over. Users under 15 may use it only with the consent of a parent or guardian. Your account is personal. Keep access to your email, as sign-in codes are sent there.

3. Coins

• Coins are virtual units used in the app (one portrait = 3 coins). They have no cash value, cannot be exchanged for money and cannot be transferred to another account.
• New accounts get free coins for one portrait, once per email address.
• You pay for what the AI draws: if a guide is not finished, you get a proportional part of your coins back (all of them if no step was drawn).
• Coins are bought through Google Play. Google Play rules also apply to payments and refunds.
• By confirming a purchase you request immediate delivery of the coins and agree that you lose the 14-day right of withdrawal once the coins are credited. This does not affect your rights if the service does not work as promised.
• If a purchase is refunded, we remove the coins from that purchase. Coins already spent are deducted from your next purchase.
• When you delete your account, your coins are lost. If we ever close the service, we will tell you at least 30 days in advance.

4. Photos you upload

Only upload photos you have the right to use: your own, or of people who agreed (for children, with a parent's consent). Photos showing nudity, violence or content that hurts someone or infringes their rights are not allowed. We use your photo only to draw your guide.

5. Guides and your drawings

You may use the guides the app creates for learning and share them. We claim no rights in your drawings. AI can make mistakes, so a guide is not always perfect.

Sharing: when you share a drawing or photo through your phone's share menu (e.g. Instagram, WhatsApp), you send it yourself and the other app handles it under its own rules. Only share your own drawings and photos of people who agree to it.

6. Prohibited use

Do not bypass the coin system, use the app automatically (bots, scripts), interfere with our servers, reverse engineer the app or use it against the law.

7. Intellectual property

The app, its design, texts and word lists belong to the provider. Descriptions and images from Wikipedia are licensed under CC BY-SA and belong to their authors.

8. Liability

We provide the app as it is. We work to keep it running without interruption but cannot guarantee it. We are liable for damage to the extent required by law. Your statutory consumer rights remain unaffected.

9. Termination

You can delete your account at any time (Settings → Account → Delete account). We may disable an account that seriously breaches these terms.

10. Changes to the terms

We tell you about important changes in the app or by email at least 14 days in advance.

11. Governing law

The law of the Republic of Slovenia applies. As a consumer you may also bring a dispute before the courts of the country where you live. Please write to info@simonsanda.com first so we can solve the problem together.
